Terms and conditions

The agreement between you and Vitality Health Club, written in plain English.

1. Plain Language

We’ve kept these Terms in plain English so they’re easy to understand. Clause headings are for guidance only and don’t form part of the agreement. Words used throughout (like “membership”, “we”, “you”) carry the same meaning across this document.

2. Cancelling After You Join

There is no separate cooling-off period. Once your membership starts, it is governed by the cancellation terms set out under Ending Your Membership below, and by the minimum term of 2 months that applies to ongoing memberships.

  • The joining fee and any fair charges for services already provided are not refunded.
  • You can give notice by email, in the app, by text message or social media message, on live chat, over the phone, or in person at either club.
  • Nothing here limits any right you have under the Australian Consumer Law, including any statutory cooling-off right that applies where a membership was sold to you through unsolicited contact.

3. Health and Safety

Your wellbeing is our priority. By joining, you agree to:

a) Physical Condition

  • Disclose all relevant health information to us before and during your membership.
  • Confirm that the information you provide is true and accurate.
  • Not use our facilities if you have a condition that may put you or others at risk.

b) Induction and Orientation

  • You may request an induction and orientation at any time, free of charge, and we strongly encourage every member to do so.
  • If you choose not to request one and you train anyway, you accept responsibility for your use of the facilities to the maximum extent permitted by law under the Australian Consumer Law.
  • Use all equipment properly and safely, and ask a staff member if you are unsure about correct use.

c) Behaviour

  • Follow our published Rules, which are provided to you during sign-up and displayed in club.
  • Treat staff and members with respect at all times.
  • Not engage in harassment, threatening behaviour, property damage, or drug use.

d) Directions from Staff

You must follow all reasonable directions from staff to ensure the safety and comfort of members.

e) Right of Refusal

We may refuse entry or cancel your membership immediately for unsafe, unlawful, or inappropriate behaviour.

f) Online Sign-Ups and Induction Waiver

  • If you join online outside of staffed hours and visit the gym before receiving an induction, you acknowledge that you are voluntarily choosing to exercise without staff supervision or instruction.
  • By doing so, you opt out of the initial induction session and accept full responsibility for your use of the facilities, including any injury, accident, or incident that may occur due to misuse of equipment or unsafe training practices.
  • To the maximum extent permitted by law under the Australian Consumer Law, Vitality Health Club is not liable for any injury or damage suffered as a result of your decision to use the gym prior to receiving staff induction or guidance. This is subject to the Liability clause below, and nothing in this clause excludes liability for reckless conduct or any other liability that cannot lawfully be excluded.
  • You may still request an induction from staff during staffed hours, and we strongly encourage all members to do so for their safety.

4. Access, Your Key and Your Account

You can enter either club with your physical fob key or through the Vitality app, which works as your key at the door. Because our clubs are open 24 hours a day and are unstaffed for much of that time, your access credential is personal to you.

  • Your fob key and your app key are for your use only. You must not share, lend or transfer either of them, or let anyone else enter using your credential.
  • You must not admit any other person through the door when you enter, including former members, guests, or children who are not signed in as members.
  • You are responsible for every entry made using your credential, and for the conduct of anyone you allow in.
  • Your account can only be signed in on one device at a time. To use the app on a different device, you must log out on the device you are currently signed in on first.
  • Tell us straight away if your phone or fob key is lost or stolen, or if you believe someone else has access to your account.
  • We may suspend or cancel your membership for misuse of an access credential. Entries are recorded, and both clubs are monitored by CCTV 24 hours a day.

5. Privacy and Personal Information

a) Privacy Policy

We collect and use personal information in accordance with our Privacy Policy, available on this website.

b) Video Monitoring

Our clubs are open 24 hours a day and are monitored by CCTV 24 hours a day, for the safety and security of members and staff.

c) Contact Details

You must keep your contact and payment details up to date.

d) Photography & Promotion

By entering our facilities and attending classes, you consent to Vitality Health Club taking photos and videos that may include you. These may be used for promotional purposes, including on social media, our website, and marketing materials. If you do not wish to appear, please notify staff and we will not use them.

e) Members Under 18

We will not use any photo or video of a member under 18 in marketing or promotional material without express written consent from their parent or guardian. That consent can be withdrawn at any time by telling us, and we will stop using the material in future promotion.

6. Membership Benefits

From your Start Date, you are entitled to access the facilities, services, and benefits attached to your Membership Type. An induction and orientation with a trainer is available on request at any time, free of charge.

  • Flexi and One Year memberships include 24-hour access to both the Berri and Renmark clubs.
  • Off-Peak memberships cover your home club from 9am to 4pm, plus one visit a week to the other club within the same window.
  • Every group fitness class on the timetable is included in every membership, with no separate class pass and no per-class fee.

7. Core Value Fitness, Loxton

We have an arrangement with Core Value Fitness in Loxton that lets our members train there as well as at our own clubs. It is available on Flexi and One Year memberships.

  • Core Value is a partner gym, not a third club of ours. It is there for the occasional session in Loxton, not as a substitute for the club you joined.
  • Visits to Core Value may make up no more than 20% of your total visits in any two month period.
  • If you go past that share, we will send you a notification. That first notice is not a penalty and nothing about your access changes.
  • If you keep exceeding the limit after that notice, your Core Value access is suspended for one month. Your access to Berri and Renmark is not affected.
  • If the pattern continues once that suspension ends, we may withdraw your Core Value access permanently.
  • Core Value set their own opening hours, conditions of entry and rules of use, and those apply to you while you are on their premises.

8. Casual and Short-Term Passes

Casual visits, visit packs and short-term passes are not memberships. They are paid once, up front, with no direct debit and no minimum term, and the clauses in this agreement covering direct debit, minimum terms and cancellation notice do not apply to them.

  • Passes are non-refundable and non-transferable once purchased.
  • Duration passes run for a fixed period from the date of purchase and cannot be paused or extended.
  • Visit packs expire on the date shown at the time of purchase, and any unused visits are forfeited on that date.
  • If you leave and return within 60 minutes of entering, that counts as one visit, not two, and only one visit is taken from a visit pack.
  • Every other part of this agreement, including health and safety, access, behaviour and liability, applies to pass holders in the same way it applies to members.

9. Vitality Junior (ages 12 to 15)

Vitality Junior is for members aged 12 to 15. Because a junior member is under 18, the agreement is entered into by their parent or guardian, who is responsible for the membership and for all fees payable under it.

  • The parent or guardian must hold an active membership for the whole time the junior membership runs.
  • A junior member must be accompanied by that parent or guardian on every visit, and does not receive an independent app key.
  • If the parent or guardian’s membership ends for any reason, the junior membership ends at the same time.
  • On the junior member’s 16th birthday, the membership automatically becomes a Flexi membership and the rate changes from $17.80 to $23.10 a week. The member then receives their own app key and independent 24-hour access, and the parent or guardian no longer needs to hold a membership.
  • That change happens on the birthday itself. It is not deferred to the end of the 2 months minimum term, and it applies even where the birthday falls inside that term.
  • We will send a reminder notification to the parent or guardian at least 14 days before the member's 16th birthday, so the change of rate is never a surprise on a bank statement.

10. Strength for Life 50+

Strength for Life 50+ is a structured, progressive program for older adults, run at our Berri club. It is not an ordinary group fitness class and has its own entry requirements.

  • Every new participant must complete a pre-entry assessment before starting. The assessment is a one-off fee of $40 and applies to members and non-members alike.
  • The assessment involves collecting health information so the program can be set at a safe level for you. If you decline to provide it, we may not be able to enrol you.
  • The program is included in every membership at no additional cost beyond the assessment fee.
  • Non-members may attend for $10 a session, or $90 for a pack of 10 sessions. Packs are non-refundable.
  • You must tell us about any change in your health or medication while you are in the program.

11. Vitality Vault

Vitality Vault is included with every membership, short-term and casual pass at no extra cost. Members and pass holders are enrolled automatically.

a) Earning Points

  • Points are earned by checking in at the gym and by checking in to group fitness classes.
  • There is a daily cap: you earn points for a maximum of one gym visit and two class check-ins per day.
  • Fitness Passport is a separate program and not a Vitality membership. Fitness Passport holders may use the gym under that program, and do not earn Vitality Vault points.
  • Additional bonus points are awarded for reaching weekly and monthly visit and class milestones.
  • Points are awarded on the check-in record held in our systems. We may correct or reverse points awarded in error, including points awarded through a technical fault or through misuse of an access credential.

b) Redeeming Points

  • 2,000 points converts to a $10 credit, issued automatically. You do not need to claim it.
  • For memberships paid by direct debit, the credit reduces your next scheduled payment. For memberships paid up front and for pass holders, it is added to your account balance for use on renewals or in-club purchases.
  • Points and credits have no cash value, cannot be exchanged for cash, and cannot be transferred to another person or account.

c) If Your Membership Ends

  • Points do not expire while your membership or pass is active.
  • If a membership or pass expires or is cancelled, your points balance is held for 60 days. If it has not been reactivated within that period, the balance is forfeited in full and cannot be reinstated.
  • Any credit already issued to your account balance is not affected by this and remains available to you.

d) Changes to the Program

  • We may reasonably update or modify how points are earned, conversion rates, or program features from time to time.
  • Should we decide to discontinue the Vitality Vault program, we will provide members with at least 30 days’ notice, giving you time to redeem accumulated points.
  • Any credit already issued to your account balance is yours and is not affected by a change to the program or by its discontinuation.

12. Ending Your Membership

  • Fixed Term: Membership ends automatically at the end of the agreed term.
  • Ongoing Memberships: Continue after the minimum term of 2 months unless you give notice.
  • Notice Period: 14 days’ notice, which you can give by email, in the app, by text message or social media message, on live chat, over the phone, or in person at either club.
  • Ending an ongoing membership before the end of the minimum term: the membership fees that would have fallen due for the remainder of that 2 months minimum term become payable. There is no separate or additional cancellation fee on top of that amount.
  • Nothing in this clause affects any right you have under the Australian Consumer Law.

13. Fees

  • Joining Fee: Covers administration and setup; non-refundable except in limited cases.
  • Membership Fees: Payable upfront (fixed term) or periodically in advance (ongoing).
  • Late/Failed Payments: A failed or declined payment may result in suspension of membership access until outstanding fees are paid. Vitality reserves the right to charge a $15 dishonour fee for each failed payment attempt, up to a maximum of two dishonour fees per billing period, in addition to any fees charged by our bank or payment provider.
  • Fee Increases: Not during your minimum term, except for the automatic change of rate when a Vitality Junior member turns 16, which is set out above. After the minimum term, we may increase fees with 30 days’ notice.

14. Direct Debit Payments

By providing payment details, you authorise us (or our payment processing provider) to collect fees. It is your responsibility to ensure sufficient funds are available.

15. Outside Providers

External trainers, physiotherapists, or other service providers may operate at our facilities. They are independent contractors, not our employees. We are not liable for their services.

16. Additional Services

Some services (e.g., PT sessions, merchandise) are separate to your membership and may carry additional terms and fees.

17. Changes to Agreement

We may make changes to these Terms or Rules. If a change adversely affects you, you may cancel without penalty, provided you notify us before the change takes effect.

18. Liability

  • Your membership is subject to the Australian Consumer Law.
  • To the extent permitted by law, we exclude liability for death or injury except where caused by our reckless conduct.
  • You are responsible for securing your personal belongings. We are not liable for lost or stolen property.

19. Damage

You are responsible for any damage caused by you or your guests through wilful or negligent actions.

20. Using This Website

These terms also cover your use of our website and app.

  • Use the site for your own lawful purposes. Do not attempt to interfere with it, gain unauthorised access to any account or system, or extract data from it by automated means.
  • The content, branding, programs and materials on this site are ours or our licensors’, and nothing here grants you a right to reuse them.
  • Parts of the site, including the member portal, class booking, online sign-up and maps, are provided by third parties and embedded here. Your use of those services is also subject to their terms.
  • We take care to keep prices, timetables and other information accurate and current, but the site is provided as-is and information may change. Where a price or condition on this website differs from your signed membership agreement, the membership agreement applies.

21. General

  • Unexpected Events: We may close facilities temporarily for maintenance or events beyond our control. Membership will be extended accordingly.
  • Intellectual Property: No rights are granted to our logos, programs, or branding.
  • Transfer: We may transfer this agreement to another provider, who will honour its terms.
  • Governing Law: This agreement is governed by the laws of the state in which your home gym is located.
